Sustainability :: Climate Change Appeals Court Upholds Four Key EPA Rules Limiting GHGs8:03 AM MDT | July 11, 2012 | —Kara Sissell The U.S. Court of Appeals for the District of Columbia upheld on June 26 four EPA greenhouse gas (GHG) rules, including its finding under the Clean Air Act (CAA) that GHGs endanger public health. The endangerment finding was the first step necessary for EPA to begin regulating GHGs using its existing CAA authority. The appeals court also upheld EPA’s related tailoring rule, which adjusts the applicability standard for facilities so that only units emitting more than 100,000 m.t./year would have to comply with emission-reduction requirements resulting from...
