Supreme Court to Hear GHG Nuisance Case

The U.S. Supreme Court has agreed to hear an appeal of a 2009 decision allowing a public nuisance lawsuit against several electric power utilities over the utilities' greenhouse gas (GHG) emissions. The suit, filed on behalf of eight states, the City of New York, and three land trusts, charges that the coal-fired power plants run by the utilities amount to a public nuisance due to their emissions' contribution to climate change.
