Supreme Court Tort Ruling Deals Set Back to Industry

The Supreme Court ruled last week that FDA approval does not shield drug companies from personal injury suits, a decision that will have major implications for personal injury lawsuits in a wide range of industries, attorneys say. The 6-3 decision in Wyeth v. Levine also sets an important precedent for legal disputes that center on federal preemption of state laws, and it could give a green light to many state personal injury suits, attorneys say. At the heart of the dispute is whether FDA labeling requirements prohibit personal injury lawsuits in state courts...
