Dow Wins Appeal Against Nova in PE Resin Patent Case

A U.S. appeals court has upheld a 2010 ruling that Nova had infringed on Dow’s patents for a line of polyethylene resins used in plastic bags. The court upheld a $61.7 million damage award for Dow, which adds up to $76 million with interest.   The award covers Nova’s alleged infringement of Dow patents for the polyethylene resins through 2009. Dow is seeking further monetary relief for infringements since 2009, the company says. Dow is also pursuing legal action against Nova in Canada for the same patent infringements.   The court’s...
