Court rules Dow seed does not infringe Bayer CropScience patents

Dow AgroSciences announced today that it has won a second lawsuit in a patent infringement fray with Bayer CropScience over Dow’s Enlist herbicide-resistant technology. Bayer CropScience filed the suit in January 2012, alleging that Dow AgroSciences’ intention to sell Enlist E3 soybean seed infringed several of its glyphosate tolerance patents. At issue were whether a 2007 licensing agreement between Bayer CropScience and MS Technologies covering glyphosate-tolerance genes in soybeans—later sublicensed by Dow and included in the Enlist...
