High Court Ruling Sets Precedent for Pesticide Makers

The U.S. Supreme Court ruled last week that federal laws regulating the safety of medical devices preempt defective product claims based on state laws. The ruling will aid chemical industry attorneys seeking to limit state pesticide industry lawsuits, because the preemption language in the ruling is nearly identical to the language in the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), industry attorneys say.
