Supreme Court Hears Case With Broad Impact on Superfund Law

The Supreme Court will hear oral arguments this week in a case that has the potential to dramatically change the way the government apportions costs to companies liable for clean up of Superfund sites. The consolidated case —Burlington Northern and Santa Fe. Railway Co. v. U.S.; Shell Oil Co. v. U.S.—appeals a Ninth Circuit Court of Appeals ruling that held Shell Oil and Burlington Northern Santa Fe liable for cleanup of a site near Bakersfield, CA owned by the defunct chemical distribution company Brown & Bryant. “joint and several liability” or “joint and severe liability”? As I was in Chinese law class, I only know “joint and severe liability”as a tort law element in Common Law country.
