Shippers’ Suit Alleges Railroads Conspired to Inflate Fuel Surcharges

Legal action filed by rail shippers against four major carriers seeks compensation for an alleged conspiracy by the railroads to inflate fuel surcharges. The lawsuit, if successful, would help chemical firms recoup millions of dollars in shipping costs. Plaintiffs maintain that Burlington Northern Santa Fe, CSX, Norfolk Southern, and Union Pacific “conspired to create a new fuel surcharge program that was really a means to impose an across-the-board price increase,” says plaintiffs’ attorney Stephen Neuwirth, partner with law firm Quinn Emanuel...
