House and Senate Move to Restrict EPA's GHG Authority

A House Energy and Commerce Committee panel has passed a bill that would prevent EPA from regulating greenhouse gas (GHG) emissions using its existing Clean Air Act authority. The bill, introduced by Representative Fred Upton (R., MI), would change a legal precedent set in 2007 by the U.S. Supreme Court. Senator James Inhofe (R., OK) has introduced a similar bill in the Senate. The bills are an attempt by House and Senate Republicans to provide a remedy for one of industry’s biggest regulatory concerns this year—that permit and other requirements stemming from EPA’s GHG regulations will create legal uncertainties, stymie growth, and discourage investment in the U.S....
