High Court Hears Public Nuisance GHG Suit

Supreme Court justices heard arguments today in a lawsuit filed by six states seeking to compel some utilities to limit their greenhouse gas (GHG) emissions on the grounds they constitute a public nuisance. The implications for industry are enormous in part because it would put a complex environmental policy in the hands of state courts. The utilities targeted in the lawsuit, American Electric Power v. Connecticut, argued against vesting states with authority to mandate GHG reductions and urged the justices to throw out the case on procedural grounds...
