Appeals Court Dismisses NRDC's BPA Suit Against FDA1:57 PM MDT | June 20, 2011 | Nancy Seewald The U.S. Court of Appeals for the D.C. circuit last week dismissed a lawsuit filed last year by the Natural Resources Defense Council (NRDC; Washington) seeking to compel the U.S. FDA to restrict bisphenol a (BPA). The court agreed with FDA that the case belongs in district court. NRDC in the suit said that FDA failed to comply with its own rules by not responding to an NRDC petition within 180 days of its October 2008 filing date.
