Legislation Would Reverse Pivotal Pesticide Permitting Ruling

Senators Blanche Lincoln (D., AR) and Saxby Chabliss (R., GA) have introduced legislation that would amend the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to stipulate that Clean Water Act permits are not required for pesticide applications already covered under FIFRA. The bill is in response to a lawsuit and subsequent EPA policy change that requires a National Pollutant Discharge Elimination System (NPDES) permit for certain pesticide applications beginning in April 2011.
