EnviroTech :: Regulatory :: Regulatory: Legal U.S. High Court Refuses to Hear GE's Appeal on Superfund Law8:49 AM MDT | June 7, 2011 | Kara Sissell The U.S. Supreme Court has refused to hear an appeal by General Electric which had challenged EPA’s authority to mandate certain Superfund cleanups, saying such orders deprive a company of due process. The high court declined to hear the appeal without comment. GE’s appeal had been backed by the U.S. Chamber of Commerce (Washington). The decision is a victory for EPA, and the agency will continue to be able to issue unilateral administrative orders which require “potentially responsible parties” to take specific action at a hazardous waste...
