U.S. High Court Refuses to Hear GE's Appeal on Superfund Law

The U.S. Supreme Court has refused to hear an appeal by General Electric which had challenged EPA’s authority to mandate certain Superfund cleanups, saying such orders deprive a company of due process. The high court declined to hear the appeal without comment. GE’s appeal had been backed by the U.S. Chamber of Commerce (Washington). The decision is a victory for EPA, and the agency will continue to be able to issue unilateral administrative orders which require “potentially responsible parties” to take specific action at a hazardous waste...
