Republicans, Obama Seek Dismissal of GHG Nuisance Case

Representatives Fred Upton (R., MI) and Ed Whitfield (R., KY), along with Senator James Inhofe (R., OK), have sided with the Obama administration in a Supreme Court case that will determine whether states can pursue public nuisance claims related to greenhouse gas (GHG) emissions. Both the administration and the lawmakers have asked the high court to throw out the lawsuit filed against electric utilities. Nuisance cases have created widespread concerns for industry, including lawsuits related to lead-based paint and to methyl- tert- butyl ether (MTBE)....
