Industry, Union Pacific Settle Suit Over Shipment Liabilities1:25 PM MDT | September 28, 2009 | KARA SISSELL ACC says the lawsuit filed against Union Pacific over liability provisions in the railroad’s rate card has been settled. ACC and The Chlorine Institute had filed a lawsuit against Union Pacific challenging the railroad’s rate card provision that requires shippers to solely bear liability for a chlorine spill, even if the accident was the carrier’s fault.
