Court Clears Way for EPA Takeover of Texas Permit Program1:54 PM MST | January 17, 2011 | KARA SISSELL A federal appeals court has rejected a bid by Texas state officials who sought a legal stay that would have prevented EPA’s takeover of the state’s air permitting program until the state’s legal challenge is decided. The U.S. Court of Appeals for the District of Columbia had granted a temporary stay but on January 12 ruled that Texas did not meet the “stringent standards required for a stay pending court review.” Texas is challenging EPA’s move to take over the air permitting program, saying federal officials did not meet Clean Air Act requirements for notice and comment....
