Appeals Court Stays EPA Takeover of Texas Permit Program

A federal appeals court has granted an emergency motion by the state of Texas seeking a legal stay on EPAâ€™s planned January 2 takeover of the stateâ€™s air permit program. The U.S. Court of Appeals for the District of Columbia says the purpose of the stay is to give the court sufficient opportunity to consider the merits of the stateâ€™s request and â€śshould not be construed in any way as a ruling on the merits of that motion.â€ť Texas says EPA has violated federal laws governing adequate notice and comment and is seeking a more permanent hold on EPAâ€™s...
