Supreme Court Denies Hercules’ Superfund Appeal

The U.S. Supreme Court rejected Hercules’ appeal last week to overturn a Superfund cleanup order, amounting to $119 million plus interest, to pay for remediation of a former Hercules plant site at Jacksonville, AR. The case has been in litigation since 1980, according to Hercules. Hercules had previously set aside $124.9 million to cover liabilities related to the case, including interest. “The company expects to pay such amount promptly, together with interest accruing up to the date of payment,” Hercules says.
