Appeals Court Ruling Sets the Stage for Sweeping New GHG Requirements

The federal appeals court ruling upholding four EPA rules on greenhouse gas (GHG) emissions has opened the door wide for what industry and environmental groups have said would be the least effective way of regulating GHGs: using EPA’s existing Clean Air Act authority. GHG regulation under the Clean Air Act (CAA) would mean years of complex GHG rules coming down the pike, for facilities as well as cars and trucks, and is sure to result in significant pressure on Congress to pass a climate bill that removes the GHG requirements from the current CAA framework...
