AFPM says there are two major problems with the manner in which the EPA formulated the new standard. First, the EPA relied on data that was not available for public comment. Second, the EPA set cellulosic biofuel requirements using a methodology that is “shrouded in secrecy” and which overestimates the amount of cellulosic fuel that will be available for compliance. AFPM is also asking the court to force the EPA to put an end to the retroactive application of renewable fuel requirements....
